Introduction

These terms apply to everyone who visits acmos.us or buys, books or takes part in anything offered through it ("the platform"). The platform is operated by Ayda's Coaching and Trainings LLC, a Delaware limited liability company ("we", "us"). By using the platform, creating an account, buying a product or booking a session, you agree to these terms. If you do not agree, please do not use the platform.

1. What the platform is

The platform offers educational courses, recordings and live classes, and connects you with independent practitioners for personal sessions.

Courses: we sell the courses on the platform under licence from the teachers who create and teach them. We are the seller and provide the website, checkout, course access and student support; the teacher remains responsible for what they teach (see section 2).

Personal sessions, mentoring and coaching with independent practitioners: these are sold and delivered by the practitioner, often through the practitioner's own booking and payment page and under their own terms. We may describe or link to them, but we are not a party to the relationship between you and the practitioner, except where a session is clearly identified as one delivered by Ayda personally.

2. Teachers are responsible for what they teach

Each course, class and training is the work of the teacher who presents it. The teacher is solely responsible for the accuracy, safety, completeness and legality of their teaching material, for any claims they make, and for any advice they give.

Views expressed by teachers are their own and do not necessarily reflect ours. We do not guarantee any result from any course.

3. Practitioners are responsible for their sessions

Practitioners who offer sessions through the platform are independent professionals, not our employees or agents. Each practitioner is solely responsible for how their sessions are run, including the video or meeting links they provide, the security of those links and calls, scheduling, any assessment or advice given, their own qualifications and insurance, and their compliance with the laws that apply to their practice.

Any concern about a session should first be raised with the practitioner. We will help pass on messages, but we do not take responsibility for the session itself.

4. Important health information

Everything offered through the platform is educational and for general wellbeing. It is not medical, psychological or other professional healthcare advice, diagnosis or treatment, and it is not a substitute for care from a licensed healthcare provider. Unless clearly stated otherwise, teachers and practitioners on the platform are not licensed medical providers.

Do not stop, change or delay any medical treatment or medication because of anything you learn or experience through the platform. Always consult your doctor about any health concern. If you think you may have a medical emergency, call 911 or your local emergency number immediately.

You take part voluntarily and at your own discretion, and you are responsible for your own health decisions.

5. Health questions and session consent

Before a session, a practitioner may ask you some health and wellbeing questions so they can understand your situation. Answering is voluntary: you choose what, if anything, to share.

No session will take place until you have read and electronically signed the Session consent form. By signing it, you confirm that you understand the nature of the session, that it is not medical care, and that you consent to us and your practitioner storing and using the information you share for the purpose of your session, as described in our Privacy Policy. You may withdraw that consent at any time; if you do, we may not be able to provide further sessions.

6. Your own practice after training

Completing a course gives you knowledge, not a licence to practise. If you go on to work with others using what you have learned, you do so as an independent practitioner. You are solely responsible for your own qualifications, professional insurance, client consent, record keeping, and compliance with the laws where you work. We and the teachers are not responsible for your work with others.

7. Who can use the platform

You must be at least 18 years old to create an account, buy a product or book a session. You are responsible for keeping your login details private and for all activity under your account.

8. Buying courses and sessions

Prices are shown in US dollars unless stated otherwise. Payments are processed by our payment providers, such as Stripe; we do not store your full card details.

Customers in the United States buy through our own checkout, and any US sales tax is added at checkout.

Customers outside the United States buy courses through a separate international checkout. For those purchases, Stripe acts as the reseller and merchant of record: Stripe processes the payment, applies any VAT, GST or similar tax for your country, and provides transaction support, and Stripe's own terms apply to that payment. Your access to the course and these terms are otherwise unchanged.

Sessions with practitioners are booked with the practitioner's availability and are subject to that practitioner's rescheduling, cancellation and payment terms, which are shown at booking.

9. Refunds and your right to cancel

Digital courses: you may request a refund within [14] days of purchase, provided you have not accessed more than [__]% of the course. [Or: digital courses are non-refundable once access has started.]

Customers outside the United States: purchases through the international checkout are also covered by Stripe's refund and consumer protection process, which may include refunds within 60 days of purchase and any cooling-off period required in your country. In the UK and EU you normally have 14 days to cancel a purchase of digital content; you will be asked to agree that access begins immediately and to acknowledge that you lose this right to cancel once access starts.

Sessions: cancellations made at least [48] hours before the session are refunded or rescheduled. Later cancellations and missed sessions are not refunded, unless the practitioner agrees otherwise.

10. Physical products, shipping and returns

Instruments such as Lecher antennas are shipped to addresses in the United States only. If you live outside the United States, please buy instruments directly from ACMOS (SBJ International).

We aim to ship within [5] business days of your order. If we cannot ship within the time stated, or within 30 days where no time is stated, we will tell you and give you the choice of waiting or receiving a full refund.

Unused items in their original condition may be returned within [30] days of delivery for a refund of the product price; return shipping is paid by you unless the item arrived damaged or was sent in error. Please report any damage within [7] days of delivery, with photos, so we can make a claim with the carrier and send a replacement.

Instruments are sold as training and dowsing instruments for educational use. They are not medical devices and are not intended to diagnose, treat, cure or prevent any condition.

11. Course content and how you may use it

All courses, recordings, manuals and materials belong to the teacher who created them or to us. Buying a course gives you a personal, non-transferable licence to access it for your own learning for the access period stated.

You may not copy, record, download (unless downloading is offered), share your login, resell, publish, or use the material to teach others or train AI systems without written permission from the owner.

12. Live classes and community spaces

Please treat teachers, practitioners and other members with respect. We may remove content or suspend accounts for abusive, unlawful or disruptive behaviour, or for sharing others' personal information. Live classes may be recorded and made available to enrolled students; if you would rather not appear, you may turn off your camera and use a display name. We will not use recordings showing students in public marketing without the student's permission.

13. Links and other services

The platform may link to other websites and services, including meeting links supplied by practitioners and payment pages run by our providers. We are not responsible for the content, security or practices of services we do not operate.

14. Limits on our responsibility

To the fullest extent permitted by law, the platform is provided "as is" and "as available". We are not liable for any indirect, incidental or consequential loss, for any loss arising from courses taught or sessions delivered by independent teachers and practitioners, or for any decision you make based on material on the platform.

To the fullest extent permitted by law, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim.

Nothing in these terms limits liability that cannot legally be limited, such as liability for death or personal injury caused by our own negligence, fraud, or your statutory rights as a consumer.

15. Your responsibility to us

You agree to cover us for any claims, losses or costs arising from your breach of these terms, your misuse of the platform or its content, or your own work with clients based on what you have learned.

16. Privacy

Our Privacy Policy explains what personal information we collect, including any health information you choose to share, and how we protect it. It forms part of these terms.

17. Changes to these terms

We may update these terms from time to time. The version in force when you make a purchase applies to that purchase. We will tell registered users about significant changes by email.

18. Law and disputes

These terms are governed by the laws of the State of Delaware, USA. If you have a complaint, please contact us first so we can try to resolve it. Any claim must be brought in the state or federal courts located in Delaware, or in small claims court where eligible.

If you live in the UK or EU, you also keep the protection of the mandatory consumer laws of your country and may bring a claim in your local courts.
